Seems like they will have some help in their drug addiction as they will be going to jail for stealing funds. No mom cannot suddenly reopen the account to cover the loss. You say they do not belong in jail et they have broken the law and that view of not being responsible for ones own actions is part of the problem in society today.Help! My friends did something terrible and need to confess to the people who were done wrong, any advice?
To answer your questions in order: Yes, and yes. No, she cannot reopen a closed bank account and put in money to cover it. No, the mother cannot be in trouble, unless they tell her, and she does nothing about it, at which she's passing a bad check, which is criminal in some places.
The easiest thing to do is to tell the mother, have the mother go to the store, and pay herself in lieu of them cashing the check. And cover a returned check fee, as well. And then, the mother should get those friends of yours into a treatment center. One where they can't leave or voluntarily check themselves out, for like, 30 days. None of these namby pamby type facilities.
The mom wouldn't be in trouble unless she knowingly gave them the checks, which from the way you talk, she didn't. I would tell your friends to fess up to her mom AND the police. They'll find out anyway.
They need to tell Mom and then give Mom the money to cover the checks and any fees that are associated with them bouncing, even if that means selling everything they own to do it.
Neither belongs in jail? They broke the law. They knew it was wrong and did it anyway (and to a family member!). When you break the law you have to face the consequences, and sometimes those consequences involve jail.
They need help? Yes, they do. And if I were Mom I鈥檇 tell them to check into rehab NOW or I was going to file a police report.
I know all about addictions. I grew up with a stepfather who was addicted to alcohol. But it is not an excuse to break the law. And as long as you attempt to use it as an excuse, then you are an enabler, and that鈥檚 making the situation even worse. So don鈥檛 even go there.
If you continue to think that neither belongs in jail, even though they stole from a relative and defrauded a store and a bank, I guarantee you that you will be one of their victims very soon.
If the bank decides to prosecute this, it will be out of your friends hands and there will be nothing ';mom'; can do either. Sure, they can confess to her and ask for her help to make restitution, but there is no way to fix this without the bank finding out about it. They don't have a few days--the banking system works pretty fast. Time to face the music.
